This data protection notice is valid for our websites starmix.de as well as shop.starmix.de.

Log files
When our website is called up, log files are recorded and remain stored for 14 days. Such log files are automatically transmitted by your browser to us or the service provider of the website.

This involves the following data:

The processing of this data is based on Art. 6 (1) lit. b) DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 (1) a) DSGVO) by implied conduct with the contact.

The data you provide to us will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your inquiry). Mandatory legal provisions - in particular legal retention periods - remain unaffected.


Font Awesome

To ensure a consistent display of fonts and icons on our website, we use dynamically embedded web fonts and icons provided by Fonticons, Inc, 307 S Main St Ste 202 Bentonville, AR, 72712-9214 United States. When you call up a page in which corresponding fonts or icons have been integrated, the required web fonts and icons are loaded into your browser cache so that texts, fonts and icons can be displayed correctly.

For this purpose, your browser must establish a connection to the servers of Fonticons, Inc., whereby Fonticons, Inc. recognizes that our website has been accessed via your IP address. Since this is a company based in the USA, technically a third-country transfer of this personal data takes place, for which there is no adequacy decision by the EU Commission. This entails the risk that you may not be able to exercise your data subject rights guaranteed in the GDPR, or not fully, and that US laws may require the provider to disclose the processed data to authorities without your knowledge.

We use Font Awesome to make our online offers appealing and consistent. This constitutes a legitimate interest pursuant to Article 6 (1) lit. f DSGVO.

OXOMI

For the presentation and communication of product and marketing information (e.g. product images and descriptions, documents, etc.) we use OXOMI, a service of scireum GmbH, Eisenbahnstr. 24, 73630 Remshalden, on our website. This is a cloud-based service that loads content from scireum GmbH servers. For this purpose, connections are established by your browser to scireum GmbH servers when you call up pages in which the tool is integrated. The servers are located in Germany. For technical reasons, your IP address and possibly browser data such as your user agent are transmitted. The data is processed by OXOMI solely for the purpose of providing the content and maintaining security and functionality. If necessary, OXOMI also stores technically necessary cookies in your browser. You can prevent the use of OXOMI and associated data processing of the service by disabling the execution of JavaScript in your browser, which can be done, for example, by a script blocker. This may result in you no longer being able to fully use all functions of our website.

Online-Shop Shopware

We operate our online store via the self-hosted e-commerce platform Shopware. There are no transfers of personal data to the provider of the platform, Shopware AG.

When you place products in the shopping cart and place an order, we collect personal data from you. The purpose of processing your data is to operate the online store, process your orders and inquiries, and ensure the security of our online store.

Legal basis: Art. 6 para. 1 letter b DSGVO.

When registering a customer account, we store your data so that you do not have to enter it again when placing a new order and only have to log in.

We offer the option of processing the payment process in our online store via the payment service provider PayPal (PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg). This is in line with our legitimate interest in offering an efficient and secure payment method (Art. 6(1)(f) DSGVO), which is widely used. In this context, we share the following data with PayPal to the extent necessary for the performance of the contract (Art. 6 para. 1 lit b. DSGVO).

The processing of the data provided under this section is not required by law or contract. Without the transmission of your personal data, we can not carry out a payment via PayPal. There is no obligation to use PayPal as a payment method, you also have the option to pay in advance, for example.
PayPal carries out a credit check for various of its services (e.g. payment by direct debit) in order to check your ability to pay. This corresponds to the legitimate interest of PayPal (according to Art. 6 para. 1 lit. f DSGVO) and serves the execution of the contract (according to Art. 6 para. 1 lit. b DSGVO). For this purpose, your data (name, address and date of birth, bank account details) will be passed on to credit agencies. We have no influence on this process and only receive the result of whether the payment has been made or rejected or a check is pending.

Your data will be stored until the payment processing is completed. This includes the period required for processing refunds, claims management and fraud prevention.

Credit check and scoring
If you order goods from us and decide to pay by invoice, we reserve the right to obtain credit information in order to assess the risk of default. For this purpose, we transmit necessary data such as your name and address to a credit agency, which makes an assessment of solvency on the basis of mathematical-statistical methods. We use this information to decide whether we can offer you payment by invoice.
The legal basis for this processing is our legitimate interest in securing our receivables according to Art. 6 para. 1 lit. f) DSGVO.

Trusted Shops Trustbadge
We have integrated Trusted Shops widgets in our online store to display Trusted Shops services such as seals of approval and collected ratings. This is done to protect our legitimate interests in optimal marketing by enabling safe shopping according to Art. 6 para. 1 p. 1 lit. f DSGVO and to increase trust in our online store. Trusted Shops GmbH, located at Subbelrather Str. 15C, 50823 Cologne, Germany, and we are jointly responsible for data protection in accordance with Art. 26 DSGVO and inform you about the essential contents of the contract in accordance with Art. 26 (2) DSGVO.
The trust badge is integrated by a US-American CDN provider (content delivery network) within the scope of joint responsibility. An appropriate level of data protection is guaranteed by standard data protection clauses and other contractual measures. When you click on the trust badge, a server log file is automatically stored on the web server, which also contains your IP address, the time of the retrieval, the amount of data transferred and the requesting provider (access data) and documents the retrieval. After collection, your IP address is immediately anonymized, which prevents an assignment to your person. The anonymized data is collected for the analysis of errors and for statistical evaluations.
After completing the order, your e-mail address is hashed and transmitted to Trusted Shops GmbH. This serves to check whether you are already registered for services with Trusted Shops GmbH and is therefore necessary for the fulfillment of our and Trusted Shops' overriding legitimate interests in the provision of the buyer protection linked to the specific order in each case and the transactional evaluation services in accordance with Art. 6 (1) p. 1 lit. f DSGVO. If you are not yet registered for the services, you will subsequently be given the option to do so for the first time. In this case, further processing is governed by the provisions and contractual agreements with the provider. Registration is optional. If you decide not to do so, the provider will delete the data collected up to that point.
Trusted Shops uses its own service providers for hosting, monitoring and logging functions to ensure trouble-free operation. The legal basis for this is Art. 6 (1) lit. f DSGVO. This may include data processing in third countries (USA and Israel). For Israel, an adequacy decision of the EU Commission exists. A comparable level of data protection for possible processing in the USA is achieved through concluded standard contractual clauses.

Contest
Through our online presence, we offer you the opportunity to participate in competitions. If you participate in one of these competitions, the data that you provide during participation will be processed exclusively for the implementation and handling of the competition. The legal basis is your consent in accordance with Art. 6 Para. 1 lit. a DSGVO.
As part of the processing of the competition, your data may be passed on to a transport company or a financial service provider if this is necessary for the payment of your prize. The legal basis for this data transfer is Article 6(1)(b) of the General Data Protection Regulation. If your data is to be published in the event of a win, you will be informed of this as part of your declaration of consent.
If you wish to withdraw your consent to the processing of your data for participation in our contests, you may do so at any time in accordance with Article 7(3) of the General Data Protection Regulation by informing us of your withdrawal. In this case, participation in the contest will no longer be possible.

Google Analytics
Our websites have integrated components of the web analytics service Google Analytics. The service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of the US-based Google LLC. Google Analytics enables us to evaluate the usage behavior of visitors to our websites. In this process, personal data is processed by us and Google.

The transfer of data to Google takes place in a third country outside the European Union (EU) or the European Economic Area (EEA). Google Tag Manager
We use the "Google Tag Manager" service on our website to enable the tracking of visitors and users of our website. Google Tag Manager is a tool of Google, a group of companies consisting of Google Ireland Ltd. (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA as well as other affiliated companies of Google LLC.
We have concluded an order processing agreement with Google. The Google Tag Manager is a supporting service that only processes technically necessary personal data. Its function is to load other components that may collect data. However, the Google Tag Manager does not have access to this data. Please note that due to the Internet Protocol (TCP), personal data is inevitably exchanged with Google when this service is integrated, which results in a third-country transfer to the USA, among other countries, for which no adequacy decision exists due to the American legal situation and certain risks cannot be ruled out. Google AdWords mit Conversion-Tracking
Our website uses Google AdWords, an online advertising service provided by Google, a group of companies consisting of Google Ireland Ltd. (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA as well as other affiliated companies of Google LLC.
We use Google AdWords to place advertisements for our products and services and to make them more relevant for users. Among other things, we use the so-called conversion tracking. This means that Google AdWords sets a cookie on your end device if you have reached our website via a Google ad. These cookies usually lose their validity after 30 days. If you visit certain pages of our website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. For illustration and advertising of our products, explanation of the functionalities, application examples as well as for the presentation of our company, you will find numerous videos embedded via YouTube on our pages. We have implemented a so-called 2-click solution, which prevents data connections to Google servers from being established when the page is set up. The content of the video is only loaded after your active click on a video overlay and your consent (Art. 6 para. 1 lit. a DSGVO) to the resulting data processing by Google. In order to minimize the tracking possibility of Google to a large extent, we have also integrated the videos via the extended data protection mode Youtube Nocookie.

Data processing in the company

We process personal data on the basis of data protection regulations of the General Data Protection Regulation (DS-GVO) as well as the Federal Data Protection Act (BDSG) and, if applicable, the data protection laws of the individual federal states. The data of the following groups of persons are processed by the respective responsible persons in the company for the fulfillment of tasks.
In detail, this means:
  • Customer and prospective customer data are processed for the execution and support of the contractual relationship or the pre-contractual relationship as well as contact inquiries and communication on the basis of Art. 6 para. 1 sentence 1 letter b) DS-GVO and Art. 6 para. 1 sentence 1 letter c) DS-GVO.
  • personal data of our suppliers and service providers as well as their employees are processed for the initiation and execution of our contractual relationships on the basis of Art. 6 para. 1 p. 1 letter b) DS-GVO and Art. 6 para. 1 p. 1 letter c) DS-GVO.
  • Employee data is stored for the establishment, implementation and termination of employment relationships (Art. 88 DS-GVO, § 26 BDSG).
  • Applicant data is stored for the purpose of conducting the application process and deciding whether to establish an employment relationship (Art. 88 DS-GVO, § 26 BDSG). Records of unsuccessful applicants are deleted a maximum of six months after the end of the application process.

Storage period

The personal data stored by us will be deleted in accordance with legal requirements. We delete the data as soon as they are no longer required for the processing purpose, a given consent is revoked or other permissions cease to apply. Data that must still be stored, for example, for reasons of commercial or tax law, or whose storage is still required for the assertion, exercise or defense of legal claims, will be deleted as soon as this is no longer the case.


Data subject rights

If we process personal data about you, you have the following data subject rights:
  • a right to information about the data processed and to be copied,
  • a right to rectification if we process incorrect data about you,
  • a right to erasure, unless exceptions apply as to why we are still storing the data, for example, retention obligations or limitation periods

  • a right to data portability,
  • a right to lodge a complaint with a data protection supervisory authority if you find that we are not processing your data properly. The State Commissioner for Data Protection and Freedom of Information in Baden-Württemberg is responsible for our company. However, if you are in another federal state or not in Germany, you can also contact the data protection authority there.
